The United States Patent and Trademark Office (USPTO) intends to award a sole source, firm fixed price contract to HILTON DURHAM NEAR DUKE UNIVERSITY, 3800 HILLSBOROUGH ROAD, DURHAM, NC 27705. Website: https://www.hilton.com/en/hotels/rdudhhf-hilton-durham-near-duke-university/ The purpose of this requirement is to secure the venue for the 40th Annual Trilateral Conference for USPTO and the Office of International Policy. The Period of Performance is November 7, 2022 – November 10, 2022 The Hilton Durham near Duke University is the only Hotel/Conference Center capable of providing the required trifecta of a meeting space with a minimum of 5000 sq. ft (as well as multiple other smaller spaces), comprehensive hospitality services including extensive food/beverage offerings for any attendees with restricted diets, and a sufficient number of hotel rooms on-site set aside at the government per diem lodging rate to accommodate a conference of this size. In accordance with FAR 13.501, restricting competition may be justified when “only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.” In accordance with 10 U.S.C. § 2304(c)(1) and 41 U.S.C. § 253(c)(1), as implemented by FAR 6.302-1, competition may be restricted when “only one responsible source or no other supplies or services will satisfy agency requirements.” Based on the market research to date completed by this agency, the Hilton Durham near Duke University meets the standards for limiting competition as stated above as the only venue that can meet the requirements for this conference. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES OR PROPOSALS; however, any firm that believes it can meet the requirements may give written notification prior to the response due date and time. Supporting evidence must be furnished in sufficient detail to demonstrate the ability to perform the requirements. Responses: Responses are due by August 18th, 2022, 13:00 p.m. (EDT). Responses shall be submitted via e-mail to Joy.Pitts@uspto.gov and Emalee.gawrelski@uspto.gov. Telephone requests or inquires will not be accepted. Please indicate in the subject of your email: “Notice of Intent-Question Submission – ACQ-23-0067”. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not be responsible for any costs incurred by responding to this notice. If no responses are received, the Government will proceed with the award.
