Original Set Aside:

The United States Army Corps of Engineers (USACE) Engineering Research and Development Center-Construction Engineering Research Laboratory (ERDC-CERL) has a requirement to procure Vortex Simulations Studio software licenses and custom hardware integration support from the software manufacturer to establish connection between the software and the 401CR Force Dynamics Simulator that the government already owns. ERDC-CERL intends to award a purchase order on a sole source basis to Simulation CM-Labs in accordance with FAR 13.106-1(b)(1). Simulation CM-Labs is the developer and manufacturer of Vortex Studio a multi-dynamic soil simulator software for construction equipment. Over the past 3 years the robotics engineering team at CERL has been utilizing Vortex in its research program and already owns several licenses. New licenses are needed as the program increases in size, and at this point in the program’s operations the government requires support with integrating it to hardware components. Vortex Studio is proprietary code to which only the developer has access. Simulations CM-Labs are the experts in the field that build custom connections to their proprietary software for customers and therefore they are the only source for this procurement. This is not a request for proposal and in no way obligates the Government to award any contract. The associated North American Industry Classification System (NAICS) code is 511210 – Software Publishers which has a size standard of $41,500,000.00. This is not a small business set aside. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government’s acquisition strategy. Please provide responses to this notice no later than December 23, 2021 at 12:00pm, Central Standard Time (CST), to: CERL-CT-QUOTES@usace.army.mil Telephone responses will not be accepted. Responses to this notice will not be considered as a response to any solicitation, a request to be added to a prospective offerors list, or to receive a copy of any solicitation. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
