This is a Notice of Intent published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This Notice of Intent is for a proposed award of a sole source firm fixed price contract to the following contractor for Metasys Building Automation Services to support of the Central Iowa VA Health Care System (VAHCS), 3600 30th Street, Des Moines, Iowa 50310-5774: Johnson Controls, Inc. DUNS: 006092860 5757 N Green Bay Ave Glendale, WI 53209-4408 This is done under authority of 41 U.S.C. 1901, as implemented by FAR 13.106-1(b)(2). This is not a request for competitive quotes. The Department of Veterans Affairs, Network Contracting Office 23 (VA) intends to award a sole source, firm fixed price contract to Johnson Controls, Inc. for proprietary software upgrade, training, maintenance and repair services for the Metasys HVAC Building Automation System currently being utilized by the VAHCS. Market research revealed that Johnson Controls, Inc. is the only authorized service provider for the Metasys HVAC Building Automation System currently being utilized by the VAHCS. Johnson Controls, Inc. is the Original Equipment Manufacturer of the Metasys HVAC Building Automation System, owns the proprietary maintenance rights for this equipment, and does not authorize others to perform installation, training, or maintenance on such equipment. The North American Industry Classification System (NAICS) code for this service is 238220 (Plumbing, Heating, and Air-Conditioning Contractors) and the Product Service Code (PSC) is J041 (Maintenance, Repair, and Rebuilding of Equipment Refrigeration, Air Conditioning, and Air Circulating Equipment). The VA understands that Johnson Controls, Inc. is the only vendor that can provide the requested services. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to satisfy the requirement, including documentation from the proprietary rights holder, Johnson Controls, Inc., that such contractor could provide this service as an authorized service provider, authorized reseller, authorized dealer or third party. All responsible sources may submit a capability statement, which shall be considered by the agency by e-mailing such statement and supporting documentation to Angela Stewart, Contract Specialist, at angela.stewart438@va.gov by 10:00am Central Time on December 28, 2021. Such documentation will be reviewed solely for the purpose of determining whether or not to conduct the procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government under authorities cited above.
