NOTICE OF INTENT FOR SOLE SOURCE ACTION The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with the Oregon Department of Environmental Quality (ODEQ), a State of Oregon agency, for permit fees to receive Clean Water Act Section 401 Water Quality Certifications from ODEQ for Mouth of the Columbia River (MCR) and Columbia & Lower Willamette Rivers (CLW) which will enable USACE to perform routine maintenance dredging and dredged material placement at the Tongue Point and Oregon Slough Side Channels in accordance with federal and state regulations. ODEQ will process the applications and issue the certifications in according with the state regulations. REASON FOR SOLE SOURCE ACQUISITION: ODEQ is the state agency that has authority to regulate, administer, and enforce environment laws in according with Clean Water Act hence ODEQ is the only state agency that can issue the Clean Water Act Section 401 Water Quality Certification. USACE must obtain a valid certification from ODEQ in order to perform routine maintenance dredging and dredged material placement at the Tongue Point and Oregon Slough Side Channels in the State of Oregon. There is no exception to this requirement. The statutory authority for this non-competitive acquisition is in accordance with 10 U.S.C. 2304(c)(1), as implemented by FAR 13.106-1(b) Soliciting from a Single Source and no other supplies or services will satisfy agency requirements.
